TERMS AND CONDITIONS OF ONLINE PSYCHOTHERAPY SERVICES

 

General provisions.

 

 

(1) These Regulations are Regulations within the meaning of Article 8 of the Act of 18.07.2002 on provision of services by electronic means (Journal of Laws of 2020, item 344. as amended).

 

(2) The Regulations define the scope and type of services provided electronically and the conditions for their provision, the rules for the conclusion and termination of agreements for the provision of services, payments, as well as the procedure for complaints.

 

(3) The company “Gabinet Psychoterapii Marzena Biernacka” provides services electronically, which means psychological, therapeutic and related consultations.

 

(4) The conclusion of the contract for the provision of services is reached by  ordering the service thus accepting the Regulations .

 

Services.

 

(1) Services provided by the company “Gabinet Psychoterapii Marzena Biernacka” are paid.

 

(2) The Service Provider provides specialist consultations realized in the form of video-consultations of the Client with the Specialist.

 

(3) Provision of services is subject to payment of a fee in accordance with the price list of services agreed with the Service Provider.

 

(4) The beginning of the process of psychotherapy is always preceded by a Consultation (usually from 1 to 3 meetings), which is intended to lead to the formulation of problems and goals for psychotherapeutic work.

 

(5) psychotherapy sessions are held once a week, unless the Specialist agrees with the Client that a higher frequency of meetings is needed.

 

(6) individual Psychotherapy Consultation/Session lasts 50 minutes, Couples/Marriage Therapy Session lasts 50 minutes or 75 minutes. If the Client is late, the Consultation/Session is not extended. If the Specialist is late, he/she will extend the Consultation/Session by the time of tardiness or ensure that the next Consultation/Session is extended accordingly by this time of tardiness.

 

(7) The cost of the Consultation/Session shall be in accordance with the Price List, and payment of 100% shall always be made prior to the Consultation/Session. The Consultation/Session will not take place in case of non-payment. A pre-arranged Consultation/Session may be cancelled by the Client at no cost, no later than 24 hours before the scheduled time. Any Consultation/Session cancelled less than 24 hours prior to the appointment or in excess of the aforementioned number shall be subject to payment in accordance with the Price List.

 

(8) To cancel an appointment you must: call +48 572 008 533 or write an email to: kontakt@brightway-psychoterapia.pl.

 

(9) Failure to cancel an appointment and not showing up for the scheduled Consultation/Session is treated as an interruption of the psychotherapeutic process, resulting in the loss of the guarantee of a permanent appointment for the Client.

 

(10) In case of absence of the Client from 3 Sessions in a row, the Client loses the guarantee of keeping a fixed appointment, which may result in losing the possibility of continuing the psychotherapeutic process.

 

(11) In case of cancellation of a Consultation/Session by the Specialist, the appointment free of charge for the Client will be forfeited, and the next Consultation/Session will be held on the same date in the following week.

 

(12) Certificates of use of the Specialist are issued only at the request of the Client and contain only the Client's data and information on when the appointments are held and at what frequency. In this case, the Specialist has the right to check the consistency of the provided personal data with the Client's identity card.

 

(13) consultations/sessions are held electronically (online) via SKYPE, SENSLY platform or other similar program (depending on the Client's capabilities and with the approval of the Specialist).

 

(14) The Client agrees to ensure confidentiality in the room where he/she is during the Consultation/Session and is provided with access to the Internet, as well as appropriate software to complete the Consultation/Session Online.

 

(15) the Client is absolutely prohibited from recording the Consultation/Session. The Specialist may record Consultations/Sessions only with the written consent of the Client.

 

 

Technical conditions

 

(1) The condition for the proper use of the services is that the Client meets the minimum technical requirements in terms of computer or telephone equipment and Internet connection, allowing to connect by audio and/or video with the Specialist via instant messenger.

 

Contract conclusion.

 

(1) The conclusion of a contract for the provision of services offered by the company “Gabinet Psychoterapii Marzena Biernacka” is reached by accepting the regulations and ordering the service.

 

(2) In order to begin using the services provided by the company “Gabinet Psychoterapii Marzena Biernacka”, it is necessary to become familiar with all the provisions of the regulations. In the case of making a reservation and using the services offered, ignorance of these Regulations does not exempt the Client from the rules contained herein.

 

(3) The Customer has the option of booking a consultation by sending an e-mail, making contact by phone, or booking an appointment through the website.

 

(4) Conclusion of a contract under which services will be provided is tantamount to the Customer's consent to the provision of electronic services.

 

(5) Booking a consultation is tantamount to consenting to the processing of the provided personal data by the Service Provider for the purpose of providing services. The Specialist may ask the Client to provide additional identification data resulting from separate regulations and aimed at the implementation of the service selected by the Client.

 

(6) In case of cancellation of the consultation by the Specialist due to fortuitous reasons, the Service Provider shall offer the Client an appointment at the nearest convenient time for the Client. The fee paid is refunded to the bank account indicated by the Client or is transferred to the next consultation.

 

(7) In the event that it is not possible to use the Online Consultation on the date booked by the User, the User is obliged to cancel the reservation immediately, but no later than 24 hours before the booked date, via e-mail sent to kontakt@brightway-psychoterapia.pl. In such case, the User shall not bear the cost of the cancelled Online Consultation. Consultations booked less than 24 hours before its scheduled start are not subject to cancellation. It is possible to reschedule the Consultation to the nearest possible date available to the Specialist.

 

(8) In case the User does not use the booked Online Consultation for any reason attributable to the User or cancels the booking after the date specified in Section 7, the fee for the Consultation will not be refunded.

 

 

Payment.

 

(1) Payment for the ordered Consultation shall be made by wire transfer to the Service Provider's bank account number or by electronic payment through the Tpay payment system.
 
(2) The payment is made when the funds are credited to the Service Provider's account.
 
(3) The recipient, upon ordering the service to be provided to him, shall pay the applicable fee. Payment for the selected consultation should be made immediately, after the selection of the service. If the payment is not made, the service will not be provided and the reservation will be cancelled.
 
(4) The Service Provider will issue an invoice at the request of the Client, after prior notification of this fact and transmission of data for its issuance to the e-mail address: kontakt@brightway-psychoterapia.pl. The invoice will be sent electronically up to 7 days from the date of completion of the service to the Client's e-mail address.

 

 

Complaint procedure and dispute resolution .

 

(1) The Client has the right to file a complaint regarding the use of the services of “Gabinet Psychoterapii Marzena Biernacka” within 7 days from the date of completion of the service or the day on which it was to be performed.

 

(2) The complaint should be made in writing and sent to the email address of the Service Provider: kontakt@brightway-psychoterapia.pl.

 

(3) The complaint should include:- the Client's data: name and surname, address of residence or registered office of the Company, e-mail address;- a presentation of the problem that is the cause of the complaint; any circumstances raised in connection with non-performance or improper performance of the contract by the Service Provider.

 

(4) The Service Provider will consider the complaint within 30 working days from the date of its delivery. The response to the complaint will be sent to the Client by e-mail to the e-mail address from which the complaint was sent.

 

(5) In the event of any dispute regarding the contract between the Parties, the Client and the Service Provider will take steps to resolve it amicably.

 

(6) In case of failure to resolve amicably a dispute concerning the contract concluded under these Regulations, the parties may pursue their claims through court proceedings, in a common court of competent jurisdiction for the seat of the Service Provider.

RODO information clause on personal data processing

 

(1) The Administrator of personal data is Gabinet Psychoterapii Marzena Biernacka, ul. Batalionu AK Karpaty 3/1, 00-712 Warsaw, NIP: 5252049913, REGON: 386732965.
 
(2) The administrator has appointed a personal data protection inspector. Contact details of the inspector:  Marzena Biernacka, 3/1 Batalionu AK Karpaty St., 00-712 Warsaw.
 
(3) The Administrator shall process personal data in order to perform the activities of the activity, based on Article 6 (1) (b) and (c) (d) and (f) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free flow of such data and the provisions of the Act of March 6, 2018. - Entrepreneurs' Law (i.e., Journal of Laws of 2021, item 162) and the Act of June 8, 2001 on the profession of psychologist and the professional self-government of psychologists (i.e., Journal of Laws of 2019, item 1026), also for the purpose of fulfilling obligations related to the conduct and service of psychotherapy meetings, resulting from separate regulations; Providing personal data is a statutory condition for conducting psychotherapy; Refusal to provide this information to the psychotherapist makes it impossible to carry out service activities and conduct psychotherapy. Objection to the processing of personal data or withdrawal of consent to the processing of data will result in the refusal to perform any activities, and such objection may be made before the performance of this activity. After it is done, the objection/withdrawal shall not affect the personal data collected and registered for the purpose of conducting the activity and the contract.
 
(4) Categories of personal data include, but are not limited to, first and last name, telephone number, e-mail address, address, data dedicated to the provision of the service;
 
(5) Your personal data may be transferred to entities that process personal data on behalf of the administrator: IT service providers;
 
(6). your personal data will be kept for the duration of the administrator's legitimate interest, unless you object to the processing;
 
(7) your data will not be transferred to a third country or international organization;
 
(8) You have the right of access to the content of your data and the right to rectification, erasure, restriction of processing, the right to data portability, the right to object, the right to withdraw your consent at any time without affecting the legality of the processing performed on the basis of consent before its withdrawal;
 
(9) You have the right to lodge a complaint with the supervisory authority in charge of personal data protection, which is the President of the Office for Personal Data Protection, if you consider that the processing of your personal data violates the provisions of the Act of May 10, 2018 on Personal Data Protection (consolidated text, Journal of Laws of 2018, item 1000) or the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) of April 27, 2016. (Official Journal of the EU.L No. 119, p. 1);
 
(10). the data provided by you will not be subject to automated decision-making and profiling;
 
(11) the data comes from the data subjects;
 
(12) your provision of personal data is voluntary;
